Under the consideration of being allowed to participate in the fitness training activities of  Revelation Wellness Studio & HQ located at 10818 N. 32nd Street, PHoenix, AZ, 85028, its representatives, and its program of Revelation Fitness and to use the facilities, equipment, and services, in addition to the payment fee of any charge, I do hereby forever waive, release and discharge Revelation Wellness Studio & HQ,  and its officers, agents, employees, representatives, executors, and all others acting on their behalf from any and all claims or liabilities for injuries or damages to my person and or/property, including those caused by the negligent act or omission of any of those mentioned or other acting on their behalf, arising out of or connected with my participation in any activities, programs or services of Revelation Wellness Studio & HQ and its representatives and the use of any equipment various sites, including home, provided by and/or recommended by Revelation Wellness Instructors.

I do hereby further decree myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation in these activities or use of equipment or machinery. I do hereby acknowledge that I have been informed of the need for a physician’s approval for my participation in the exercise activities, programs, and use of exercise equipment. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and consultation with my physicians as to physical activity, exercise and use of exercise equipment. I acknowledge that I have either had a physical examination and have been given my physician’s permission to participate OR I have decided to participate in the exercise activities, programs and use of equipment without the approval of my physician and do hereby assume all responsibility for my participation in said activities, programs and use of equipment.

I understand that Revelation Wellness its representatives  and its programs, in providing and maintaining an exercise/fitness program for me, do not constitute an acknowledgement, representation, or indication of my physiological wellbeing or medical opinion relating thereto.


Video / Photo Release:
I hereby grant Revelation Wellness (“RW”) the irrevocable right and permission to use photographs and/or video recordings of me on the RW website and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to me.  I, the undersigned, agree that without compensation, further consent, and/or credit in all jurisdictions for all time that:

1. I grant irrevocable consent to RW, its successors, assigns, and licensees to include my name, image, likeness, appearance, voice, mannerisms, professional and personal biographical information, signature and other personal characteristics and private information, and all materials created by, or on behalf of RW, that incorporate these “ Materials ” in the Production, in trailers, promotional videos and photography, and advertisements for the Production in all media now known or hereafter devised;

2. The Production, Materials, and all derivatives are RW’s sole property;

3. I hereby irrevocably transfer, assign, and convey to RW my right, title, and interest, if any, in the Materials and Production and all copyrights and other intellectual property rights in the Materials or Production, including the right to sue to enforce copyrights against infringers;

4. I irrevocably waive all rights of publicity, privacy, and other rights in the Materials or Production; Understand that I am authorizing RW to publicize and commercially exploit my name, likeness, and other personal characteristics and private information;

5. I irrevocably waive all rights to bring an action at law or equity related to the Production of Materials against RW and its successors, assigns, licensees, and agents, and the employees, officers, directors, and agents, and release and discharge them from all liability related to the Production or Materials ;

6. A formal legal ruling that a provision of this Agreement is invalid, illegal, or unenforceable, will neither diminish the other provisions of this Agreement nor invalidate nor render unenforceable this Agreement in another jurisdiction;

7. All matters arising out of this Agreement are governed by, and construed in accordance with, Arizona law without giving effect to choice or conflict of law rule. A claim arising under this Agreement may be brought only in the federal and state courts located in Maricopa County, Arizona. I hereby irrevocably consent to the exclusive jurisdiction of these courts;

8. No additional consent from, authorization from, or payment to, a third party is required for me to sign, deliver and perform this agreement. These rights and license granted hereunder neither violate a right (including without limitation, copyright, trademark, trade secret, right to privacy, or right of publicity) of, nor conflict with, nor violate my contract with, any other person or entity;

9. This Agreement contains our entire agreement on this subject and supersedes all prior understandings, agreements, representations, and warranties, both written and oral; and,

10. Prior to signing I read and understood all of the terms of this agreement and acknowledged that this agreement provides RW with my absolute and unconditional consent, waiver, and release of liability.
